Child Care Provider Guidelines

As updated July 2018

These Trusted Child Care Provider Guidelines (the “CCP Guidelines”) supplement and are made a part of the Employment Agreement you, as a Trusted Child Care Provider (“you”, or “CCP”), executed with Trusted Labs, Inc. (“Trusted”, or the “Company”), in connection with Trusted’s hiring of you as a CCP (the “Employment Agreement”). Any term used herein and not defined will have the meaning assigned to it in the Employment Agreement. These CCP Guidelines govern your Employment with Trusted as well as your use of the Trusted website at www.usetrusted.com (the “CCP Site”) and the Trusted Child Care Provider mobile application (the “CCP Application”). Your use of the CCP Site and CCP Application in connection with your Employment constitutes your acceptance of and agreement to all of the terms and conditions in these CCP Guidelines.

The Company reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of these CCP Guidelines and review, improve, modify or discontinue, temporarily or permanently, the CCP Site and CCP Application or any content or information located within the CCP Site and CCP Application at any time.

These CCP Guidelines are organized into the following sections:

  1. Terms of Employment
  2. Code of Conduct
  3. Terms of Service for using the CCP Site and CCP Application

1. Terms of Employment

Availability and Scheduling

At the time of hire, the Company and CCP shall agree on the CCP’s initial availability and schedule to provide Child Care services (“Child Care Services”) to third-party users of Trusted’s publicly available mobile application (“Users”). This schedule shall be included in the CCP Calendar found in the CCP Mobile Application, and the time marked as available (“Available Time”) will be committed time with respect to which Users can request that the CCP provide Child Care Services for a child or children under such User’s care (each, and together with others if multiple, a “Child”). Each such request made by a User shall be called a “Job Request”. The CCP shall, at minimum, add, update, and/or confirm their Available Time each Monday following their Start Date by noon PST in the CCP Application.

In the event a CCP must change its availability outside of the weekly Monday check-in, any such change must be done immediately by using the CCP Application. If a change to a CCP’s Available Time is within 24 hours of an already confirmed Job Request, the change will be considered a Cancellation (as defined below under “Job Requests”).

Trusted reserves the right to send Job Requests to the CCP that fall outside of the CCP’s Available Time, such as recurring bookings, early starts/finishes, etc. However, the CCP has no responsibility to accept any such Job Requests.

Under no circumstances shall the CCP talk, email, text, or otherwise interact with any User in connection with scheduling or paying for Child Care Services other than through the Trusted Parent Application. Violation of this restriction may result in immediate termination of the CCP’s Employment with Trusted.

Job Requests

If there is a Job Request within the CCP’s Available Time, Trusted will notify the CCP via the CCP Application by push notification, an email, a text, and a calendar invite (each a “Job Notification”). The CCP must respond to the Job Notification by confirming the booking in the CCP Application, (1) within 15 minutes of receipt of a Job Notification if it is sent during the CCP’s Available Time and (2) within 90 minutes of receipt of a Job Notification if it is sent during the CCP’s Active Time or outside of the CCPs Available Time.

Provided that Trusted contacts the CCP about a Job Request through the CCP Site and CCP Application with at least 2.5 hours prior notice, the CCP must accept the Job Request. If the CCP declines a Job Request (a “Cancellation”), the CCP will forfeit the right to be paid the compensation that would otherwise be payable to the CCP in connection with that Job Request, and for any Cancellations within 24 hours of the Job Request start time, the CCP will forfeit one (1) hour of pay unless valid Cancellation documentation is provided within 72 hours to the Company. After 3 Cancellations, including any caused by a change to Available Time with less than 24 hours’ notice as described above, the CCP may be subject to immediate termination of Employment. However, any decline of a Job Request because of a personal emergency (as determined in Trusted’s sole discretion) shall not be considered a Cancellation.

Wages

During your Available Time, Trusted will pay you your base rate per hour for each hour you are providing Child Care Services pursuant to a Job Request (each a “Job Booking”, and the time spent thereunder, your “Active Time”). For each additional Child beyond one (1) Child under your care during any given Job Booking, you will receive an additional 20% per hour.

Any gratuities paid by Users and any out-of-pocket expenses incurred by CCPs during a Job Booking shall be paid directly to the CCP by the User at the completion of the Job Booking.

Privacy Policy

You as an employee of Trusted, must at all times be in compliance with Trusted’s CCP Privacy Policy found at www.usetrusted.com/privacy.

Non-Solicitation

For a period of one (1) year immediately following the termination of your employment as a CCP with Trusted, unless otherwise provided by Trusted in writing, you agree not to directly or indirectly engage or solicit any User for, or in connection with, providing, scheduling or paying for Child Care Services.

Press/Media Policy

You as an employee of Trusted, are not permitted to speak with the media (print, blog, social, or broadcast) on behalf of Trusted "on" or "off" the record at any time without advance written approval by Vivian Chan or Anand Iyer. 

If approached by a member of the media (print, blog, social, or broadcast), you must directly refer them to Vivian Chan or Anand Iyer by having them e-mail their request to press@usetrusted.com. If possible, secure the person’s business card or contact information.

After you've been contacted by the media, you must e-mail Vivian@usetrusted.com and Anand@usetrusted.com as soon as possible to report that you were approached by a member of the media

2. Code of conduct

We expect a professional and personable demeanor from each of our CCP’s as a way to build trust and rapport with each User and to provide great Child Care Services for Users. This Trusted Code of Conduct outlines the behavior guidelines relating to Job Bookings and the provision of Child Care Services that each Trusted CCP is expected to abide by during the course of their Employment.

You, as a Trusted CCP, agree that during the provision of Child Care Services as a CCP (each time, a “Job Booking”), you will:

  1. Prioritize the safety of the Child in all situations.
  2. Aim to arrive 15 minutes prior to the start time for all Job Bookings. This ensures sufficient time for the CCP and the parents’, or others who hired you for the Job Booking and (each a “Parent”) to cover key questions on Child status, Child likes/dislikes, emergency contacts and procedure, etc.
  3. Clean any mess created while caring for the Child. This is considered a bare minimum in terms of clearing and cleaning used dishes, toys, clothing, etc. In the course of this, the CCP should strive to include all items in the proximity – i.e., as you clean or load the dishes used for the Child’s meal, clean and load all dishes in the sink, wipe down the entire counter and table, not just the section used by the Child; etc.
  4. Keep in mind that customer experience comes above all else. We want Parents to recognize the exceptional care, value, and service of our Trusted CCPs. Throughout the Job Booking, maintain the perspective of the Parent to deliver above and beyond what is expected. In addition to giving the Child a wonderful and safe experience, you should use time that the Child is napping or down for the evening to help with obvious light household chores in the main areas of the Child’s room, kitchen, and living room – e.g., washing or loading dishes in the sink or lying around.
  5. Not watch TV or use your mobile device (except to communicate with the user) while caring for the Child. You are there to engage with the Child and in no circumstances should TV or a mobile device be used as a substitute.
  6. Remain calm and provide Child with a fun and safe time.
  7. Call Trusted Customer Support at (617) 739-5437 Ext. 2 immediately if there is doubt.
  8. Not invite anyone over to the home where you are providing Child Care Services.
  9. Dress in conservative manner, e.g., no ripped jeans, no cropped tops, no low cut tops. Minimize jewelry and do not wear long necklaces, large hoops, or anything a young Child could grab and tear at. Carry a pair of spare socks that you can put on when in a no shoes home environment.

You, as a Trusted CCP, agree to take the following steps prior to each Job Booking, upon arrival at the Job Booking, and upon completion of the Job Booking:

  1. Prior to Arrival
    1. Commit the names of the Parents and the Child to memory.
    2. Plan for the Job Booking (go outside, play, nap time, sleep time, feeding, medications etc.).
  2. Upon Arrival
    1. Greet and address Parents by name.
    2. Ask if shoes on/off.
    3. Wash your hands (or use hand sanitizer).
    4. Go over the Child’s profile and status with Parents:
      1. What is the Child’s current state, e.g., mood, energy level?
      2. What is the Child’s schedule and routine for the duration of the Job Booking, e.g., meal times and food location, bottle, naps, bath, evening and bedtime?
      3. For nap and bedtime, what is the earliest/latest Child can go down, what is the sleep policy - put Child down, hold Child until tired, allow Child to cry for what length of time?
      4. What are the Child’s favorite toys and activities? Any likes/dislikes?
      5. Is the Child allowed screen time with any electronics, e.g., TV, smartphone, tablet?
      6. Where is all the relevant gear, e.g., bottles, spare cloths, favorite toys and blankets?
      7. Is the Child taking any medicine?
      8. Does the Child have allergies?
      9. Any other important things to note, e.g., signals when the Child is getting tired or hungry?
    5. Confirm the Parents’ and Emergency contacts numbers
    6. If there is a house phone, how should incoming calls be handled?
    7. If someone comes to the door, how should that person be handled?
    8. Request a set of keys to the unit, especially in case of emergency.
    9. Ask what the protocol is in case of an emergency
      1. Where is the first aid kit?
      2. Where is the nearest fire extinguisher?
      3. Where are fire exits?
    10. Ask if parents would like updates via the app (messages, pictures) over the course of the booking
    11. Confirm whether the parent would like to enable the video feed for the Job Booking. If yes, set up the device and initiate the feed.
    12. Ask if there are any light household tasks in the Child’s room, kitchen, living/dining room that you can help with while the Child is napping or after the Child has gone down.
    13. Lock the door upon Parents’ departure.
  3. During Job Booking
    1. Play with the Child a safe distance from glass doors and windows.
    2. Stay focused on the Child at ALL times.
    3. Never leave a Child unattended, including when Child is on a changing table, in a highchair or stroller, or in the bath.
    4. If consented to by the Parent on the Parent Profile, send the Parent images via the Trusted CCP mobile application of the Child over the course of the Job Booking at a memorable moment. Keep in mind Child’s safety such that picture taking in no way leaves Child in a precarious situation.
    5. Check on the sleeping Child every 30 minutes.
    6. While the Child are sleeping, ensure you have the baby monitor on and close to you.
    7. Always ensure you can hear a call from every Child at all times.
  4. After Job Booking
    1. Tap “End” in the Provider Application to end the Job Booking.
    2. Be cheerful and cordial as you thank the Parents.
    3. Complete and leave behind a Trusted summary sheet. Call out anything of note to the Parents - about the Child, any issues.
    4. Do not rush out or act hurried to leave.

3. Terms of Service for using the CCP Site and CCP Application

Account, Password, Security and Mobile Phone Use

You must register with the Company and create an account to use the CCP Site and CCP Application. You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or Company for accessing the CCP Site and CCP Application. You are solely responsible for all activities that occur under your password or account. Should you suspect that any unauthorized party may be using your password or account or you suspect any other breach of security, you will contact Company immediately.

By providing your email address and mobile phone number and using the CCP Site and CCP Application, you hereby affirmatively consent to our use of your email and mobile phone number for emails, calls, texts and push notifications in order to perform and improve upon the CCP Site and CCP Application. The Company will not assess any charges for calls or texts, but standard message charges or other charges from your wireless carrier may apply. You may not opt-out of receiving text messages from us.

Acceptable Use; Public Areas

The CCP Site and CCP Application will be made available to you upon your Employment with Trusted and shall only be used in connection with activities conducted by you as part of your Employment and any Job Bookings, including without limitation scheduling and providing Child Care Services. Without limitation, while using the CCP Site and CCP Application, you may not:

  1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as, but not limited to, rights of privacy and publicity) of others, including Users. Parents other CCPs and Company staff.
  2. Publish, post, upload, distribute or disseminate any profane, defamatory, infringing, obscene or unlawful topic, name, material or information.
  3. Use the CCP Site and CCP Application for any purpose, in violation of local, state, national, or international law.
  4. Upload files that contain software or other material that violates the intellectual property rights (or rights of privacy or publicity) of any third party.
  5. Upload files that contain viruses, Trojan horses, corrupted files, or any other similar software that may damage the operation of another's computer.
  6. Post or upload any content to which you have not obtained any necessary rights or permissions to use accordingly.
  7. Advertise or offer to sell any goods or services for any commercial purpose through the CCP Site and CCP Application which are not relevant to the services offered through the CCP Site and CCP Application.
  8. Conduct or forward surveys, contests, pyramid schemes, or chain letters.
  9. Impersonate another person or allow any other person or entity to use your identification to post or view comments.
  10. Use a robot, spider, manual and/or automatic processes or devices to data-mine, data-crawl, scrape or index the CCP Site and CCP Application in any manner.
  11. Hack or interfere with the CCP Site and CCP Application, its servers or any connected networks.
  12. Adapt, alter, license, sublicense or translate the CCP Site and CCP Application for your own personal or commercial use.
  13. Remove or alter, visually or otherwise, any copyrights, trademarks or proprietary marks and rights owned by Company.
  14. Upload content that is offensive and/or harmful, including, but not limited to, content that advocates, endorses, condones or promotes racism, bigotry, hatred or physical harm of any kind against any individual or group of individuals.
  15. Upload content that provides materials or access to materials that exploit people under the age of 18 in an abusive, violent or sexual manner.
  16. Use the CCP Site and CCP Application to solicit for any other business, website or service, or otherwise contact Users for employment, contracting or any purpose not related to use of the CCP Site and CCP Application as set forth herein.
  17. Use the CCP Site and CCP Application to collect usernames and or/email addresses of Users by electronic or other means.
  18. Register under different usernames or identities, after your account has been suspended or terminated.

The CCP Site and CCP Application may contain profiles, email systems, blogs, message boards, applications, job postings, chat areas, news groups, forums, communities and/or other message or communication facilities (“Public Areas”) that allow CCPs to communicate with other CCPs and Users. You may only use such community areas to send and receive messages and material that are relevant and proper to the applicable forum. You understand that all submissions made to Public Areas will be public and that you will be publicly identified by your name or login identification when communicating in Public Areas, and Company will not be responsible for the action of any Users with respect to any information or materials posted in Public Areas.

Child Information and Likeness

You understand that when a User signs up on Trusted’s publicly available mobile application to hire a CCP for Child Care Services, they submit personal information about themselves and the Child, such as name, address, mobile phone number and age, as well as information about the Child that may be relevant to the Child Care Services, such as physical or mental condition, preferences, diet, photo images, etc. Users also have an option to ask for the CCP to send them images and videos of their Child taken by the CCP during a given Job Booking, and/or be provided with geolocation information of the Child during the Job Booking based on information collected from the CCP’s mobile device. All information and content relating to a User’s Children provided by the User on registration as well as sent to User by a CCP during a Job Booking is defined as “Child Information”.

You must treat the Child Information as confidential information of that Parent, only sending the images and videos to the specifically designated Users and deleting all images and videos at the end of the Job Booking. You understand that, even though some of the Child Information is created and provided by you on a mobile device that may be owned by you, Users requesting such images and videos retain sole ownership of any and all rights to these images and videos. You represent and warrant that you will not use, reproduce, modify, or create derivatives of such images and videos and that you have no rights to exhibit, distribute, display, perform, transmit, broadcast on any and all media, including, without limitation, the internet, any images or videos of any Child taken by you during a Job Booking, even at the request of a Parent.

Your Information and Likeness

“Your Information” is defined as any information and materials you provide to Trusted in connection with your registration for and use of the CCP Site and CCP Application, including without limitation that posted on your CCP Profile Page. The information and materials described in this Section, as provided by each CCP, is collectively referred to herein as “CCP Generated Content.” You hereby represent and warrant to Company that Your Information (a) will not be false, inaccurate, incomplete or misleading; (b) will not be fraudulent; (c) will not infringe any third party's copyright, patent, trademark, trade secret or other proprietary right or rights of publicity or privacy; (d) will not violate any law, statute, ordinance, or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (e) will not be defamatory, libelous, unlawfully threatening, or unlawfully harassing; (f) will not be obscene or contain child pornography or be harmful to minors; (g) will not contain any viruses, Trojan Horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; and (h) will not create liability for Company or cause Company to lose (in whole or in part) the services of its ISPs or other partners or suppliers.

You hereby grant the Company a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise all copyright, publicity rights, and any other rights you have in Your Information, in any media now known or not currently known in order to perform and improve upon the CCP Site and CCP Application.

Each CCP who provides to the Company any videotape, film, record, photograph, voice, or all related instrumental, musical, or other sound effects, hereby irrevocably grants to the Company the non-exclusive, fully-paid, royalty-free, transferable, sublicensable, worldwide, unrestricted, and perpetual right to:

  1. Use any videotape, film, record or photograph that such CCP provides to the Company, and use, reproduce, modify, or creative derivatives of such CCP picture, silhouette and other reproductions of their physical likeness (as the same may appear in any still camera photograph and/or motion picture film or video) (collectively the “Physical Likeness”), in and in connection with the exhibition, distribution, display, performance, transmission, broadcasting on any and all media, including, without limitation, the internet, of any videos or images of such CCP in connection with the CCP Site and CCP Application.
  2. Reproduce in all media any recordings of such CCP’s voice, and all related instrumental, musical, or other sound effects (collectively, the “Voice”), made in connection with the CCP Site and CCP Application.
  3. Use, and permit to be used, such CCP’s Physical Likeness and Voice in the advertising, marketing, and/or publicizing of the CCP Site and CCP Application in any media.
  4. Use, and permit to be used, such CCP’s name and identity in connection with the CCP Site and CCP Application.

CCP hereby waives all rights and releases the Company from, and shall neither sue nor bring any proceeding against any such parties for, any claim or cause of action, whether now known or unknown, for defamation, invasion of right to privacy, publicity or personality or any similar matter, or based upon or relating to the use and exploitation of CCP’s identity, likeness or voice in connection with the CCP Site and CCP Application.
